Terms of Service
Last updated: April 30, 2026
These Terms of Service (“Terms”) govern your access to and use of My DA Hub (the “Service”), provided by ALM Corp (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility & Accounts
- You must be at least 16 years old to use the Service.
- You are responsible for the accuracy of the information you provide and for keeping your credentials confidential.
- You are responsible for all activity under your account, including activity by team members and clients you invite.
- You may not share login credentials. Each human user must have a separate account.
2. Roles & Workspaces
The Service supports multiple roles (e.g., Admin, Management, Sales, Internal Team, Agency Owner, Agency Team, End Client) within an organization or agency workspace. Higher-privileged roles can grant, modify, or revoke access for users they invite. If you are invited to a workspace, the owner of that workspace controls your access and the data you can see.
3. Plans, Trials & Billing
- Some features are offered free; others require a paid subscription. Pricing is shown at the point of purchase.
- Subscriptions renew automatically until cancelled. You can cancel anytime from Settings › Billing; cancellation takes effect at the end of the current billing period.
- Fees are non-refundable except where required by law or expressly stated (such as an active money-back guarantee).
- We may change pricing on at least 30 days’ notice; changes apply to the next renewal.
4. Your Content
You retain all rights to the content you upload, create, or transmit through the Service (“Customer Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and create backups of Customer Content solely to provide and improve the Service for you.
You are responsible for the legality of Customer Content and for having the rights and consents needed to upload it (including data of leads, contacts, and clients).
5. Acceptable Use
You agree not to:
- Violate any law or third-party right.
- Send spam or unsolicited messages, including via the Mail and marketing-campaign features.
- Upload malware, attempt to break security, or probe for vulnerabilities.
- Reverse-engineer, scrape, or resell the Service without our written permission.
- Use the AI features to generate content that is unlawful, deceptive, defamatory, or that infringes IP rights.
- Interfere with the integrity or performance of the Service for other users.
We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.
6. Third-Party Integrations
The Service can connect to third-party tools (Gmail, Outlook, calendars, storage, payment processors, AI providers). Your use of these tools is governed by their own terms. We are not responsible for the availability or behavior of third-party services.
7. AI Features
The Service includes AI-generated outputs (suggestions, drafts, scoring, chatbot responses). Outputs may be inaccurate or incomplete and should be reviewed before acting on them. You are responsible for any decisions you make based on AI output.
8. White-Label / Agency Use
If you operate an agency workspace with custom branding or a custom domain, you may present the Service to your clients under your brand, subject to these Terms. You remain responsible for your clients’ use of the Service and for any representations you make to them about it.
9. Intellectual Property
The Service, including all software, design, trademarks, and content (other than Customer Content), is owned by ALM Corp or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
10. Confidentiality
Each party agrees to protect the other’s confidential information using at least the same care it uses for its own confidential information of similar sensitivity, and not to use it except to perform under these Terms.
11. Suspension & Termination
- You may stop using the Service and delete your account at any time.
- We may suspend or terminate access for material breach, non-payment, security risk, or as required by law.
- On termination, your right to access the Service ends. We will make Customer Content available for export for at least 30 days, after which it may be deleted as described in our Privacy Policy.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALM CORP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER.
14. Indemnification
You agree to defend and indemnify ALM Corp against claims arising out of (a) your Customer Content, (b) your use of the Service in violation of these Terms or law, or (c) your violation of the rights of a third party.
15. Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction in which ALM Corp is registered, without regard to conflict-of-laws rules. The parties consent to the exclusive jurisdiction of the courts located there for any disputes not subject to mandatory arbitration or small-claims processes.
16. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced in the app or via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
